The following conditions form the basis of your contract with Devon Riding Holidays, West Steart Farm, Stoodleigh, Tiverton, EX16 9QA, UK.
When making a booking you guarantee that you have the authority to accept and do accept on behalf of your party the full terms of these booking conditions. A contract will exist as soon as we issue our confirmation invoice. This contract is made on the terms of these booking conditions, which are governed by and shall be interpreted by English law.
All activities are undertaken at the customers own risk.
It is a condition of your holiday booking that all customers have personal accident insurance which covers them for horse riding and that details of this insurance are to be provided on the booking form. We strongly recommend that you have holiday insurance that will cover your expenses in the event that you have to cancel.
The deposit required at the time of provisionally booking your holiday is non refundable and is accepted as part payment of the total price. A contract is constituted between the customer and Devon Riding Holidays once a completed booking form with deposit has been received and a written confirmation invoice has been sent.
The balance of the cost of the holiday must be paid no later than six weeks before the commencement of the holiday. Should the balance not be paid by that date Devon Riding Holidays reserves the right to treat the booking as a cancellation.
Should the customer wish to make changes to their holiday once it has been confirmed, they must notify Devon Riding Holidays who will do their best to make the changes although cannot guarantee to do so. Should the changes implement any additional costs, then the customer agrees to these and they will be included in a reissued confirmation invoice.
Late bookings may be accepted subject to availability provided that the entire amount of the holiday price is received in advance of the commencement of the holiday.
If the customer wishes to cancel their booking more than six weeks before commencement of the holiday then any money paid less the deposit will be refunded. No money can be refunded should the customer cancel within the six weeks before the holiday even if the reasons are because of health or fitness. Cancellations must be made in writing.
Devon Riding Holidays reserves the right to cancel any holiday and in such an event the full sum paid by the customer will be refunded and the contract between customer and Devon Riding Holidays is thus terminated. Devon Riding Holidays accepts no liability for any costs incurred by the customer including any travel arrangements made and paid for. If any of the holiday doesn’t take place by reason or circumstances beyond Devon Riding Holidays control, “force majeure” (adverse weather conditions, natural disaster, civil unrest etc.) then Devon Riding Holidays is entitled to deduct any costs expended by them for the holiday from the refund.
All information contained on the website and in the brochure is produced in good faith and believed to be correct however the provision of certain facilities therein referred may be limited, not available at certain times or subject to weather conditions etc. Devon Riding Holidays reserves the right to change, alter or curtail the accommodation, riding itinerary, routes and services provided by both themselves and other providers for any reason beyond their control or for the wellbeing and safety of all concerned on the holiday. Bad weather /terrain conditions or events in the area could lead to a change in riding itinerary, in which case customers will be notified as soon as possible. Devon Riding Holidays will endeavour to provide as similar an experience with any amendments. Right is reserved to alter the price from that stated on any brochure or the website at any time before a holiday is booked.
All passport, visa, health certificate requirements are the responsibility of the customer and Devon Riding Holidays cannot accept any responsibility for any delay or expenses incurred through any irregularity in any travel, legal or insurance documents. Luggage is the responsibility of the customer and Devon Riding Holidays cannot accept any responsibility for any luggage if in the unlikely event it is stolen or damaged and the customer should therefore ensure that they have adequate insurance.
If the customer has any special requests which would enhance their experience of the holiday, these must be made during the initial enquiry or during the provisional booking in order for Devon Riding Holidays to assess if they can be accommodated. If the customer has a medical condition or disability which may affect their holiday then this must be stated on the booking form so that we can advise of the suitability of the holiday chosen. Devon Riding Holidays reserves the right to decline a reservation should they feel they are unable to accommodate the needs of the customer, or if full details are not given at the time of the booking, cancel the holiday when they become aware of these details.
The customer accepts full responsibility for any damage or loss caused by them or a member of their family. Full payment for any such damage or loss must be made at the time to the appropriate party. Devon Riding Holidays expects all their customers to behave in a way that reflects consideration to other people, animals and the countryside, and reserves the right to immediately terminate any holiday arrangements of a customer who behaves in any way detrimentally to cause any distress, annoyance, danger or damage to any other person directly involved with the holiday or third party. In this situation the customer will be required to leave immediately. No refunds will be made or contributions towards any additional expenses resulting in this kind of termination of a holiday.
Whilst riding or in vicinity of the horses, the customer must abide by the rules and instructions of the Devon Riding Holidays guides. It is a condition of booking that the customer accepts that the guide is entitled to require them to dismount or refuse a ride or terminate the holiday if the guide for any reason, including but not limited to inability, behaviour or health, believes the customer could endanger the safety or welfare of any person or the horses. Should this situation occur the customer is not entitled to any compensation or refund.
Customers are expected to wear a riding hat to current safety standards; EN1384, PAS015, or ASTMF1163 95. Customers need also to acknowledge that there are risks involved with horse riding, dealing with horses and understand that horses can be unpredictable and act unexpectedly. Customers must also acknowledge that the nature of the holidays organised by Devon Riding Holidays take them into remote areas where the wildlife, terrain and other conditions hold a potential danger and as such accept and understand these risks.
Devon Riding Holidays wishes to provide as flexible a holiday as in their power to do so. Customers may sometimes wish to adapt their holiday once at West Steart Farm once they are accustomed to their pony or after experiencing the terrain in order to enhance their enjoyment. Devon Riding Holidays will do all they can to accommodate any changes, but may be limited by their contract to other holiday customers. If the customers riding itinerary is reduced due to any of these changes, there can be no refund or deductions from the amount paid. Similarly, if the riding itinerary is increased, Devon Riding Holidays will not make any surcharges.
Data Protection; information supplied to Devon Riding Holidays will be held in accordance to the data protection act but may also be made available to any relevant parties involved with creating the customers holiday. It may also be passed on if required by law to any government or public bodies or to any insurers in the event of an accident. Unless a customer requests otherwise, customer information is held to send out future brochures or information on Devon Riding holidays. Customer privacy is respected and information is not sent out to any third party not connected with Devon Riding Holidays without the customer’s permission.
